1. Purpose
These Terms of Service (ยซ ToS ยป) define the terms for accessing and using the website https://drawnlights.show, the web application, and associated subdomains (together, ยซ the Service ยป), operated by Drawn Lights SASU, registered with the RCS of Nanterre under number 990730665, with its registered office at 12 promenade des pins, 92400 Courbevoie, FRANCE.
By accessing the Service, the user acknowledges having read these ToS and agrees to comply with them.
2. Definitions
The capitalized terms below have the meanings set out here, whether used in the singular or plural.
2.1. Service and overall structure
- Drone shows means any synchronized aerial performance using light drones, operated by a Producer, using Content from the Service.
- Service means all features, applications, websites, platforms, and software interfaces operated under the Drawn Lights brand, notably accessible at drawnlights.show and its subdomains.
- Drawn Lights means the company operating the Service, as well as its subsidiaries, partners, and technical or commercial providers acting on behalf of the Service but not considered Users.
- Platform or Application means any technical version of the Service, whether web, mobile, software, or API.
- Exploitation Rights means non-exclusive, non-transferable and non-sublicensable rights granted by an Artist to a Producer, a Client or to Drawn Lights, for the sole purpose of creating Drone Shows. This right authorizes, including outside the Service: (i) the use and integration of the Content in one or more Drone Shows, (ii) adaptations strictly necessary for their production, (iii) the reproduction and representation of the Content for the promotion, capture and distribution of said Shows. This right does not authorize the resale, rental, sub-licensing, redistribution, or republication of the Content (on the Platform or elsewhere) under the name of the Producer or a third party, nor its use in a competing service. Any provision of the Content source is solely to enable the authorized exploitation and does not entail any transfer of intellectual property. Drawn Lights does not ensure control over subsequent uses and is not responsible for violations committed by Users except if committed on the Platform. The Exploitation Right is granted for the purpose of creating a Drone Show and in any case benefits the Producer responsible for its implementation.
2.2. Users and stakeholders
- User means any natural or legal person who is a Visitor or holds a User Account and uses the Service in accordance with these Terms.
- Visitor means any person accessing the Service without creating a User Account.
- User Account means the personal space created by a User to access Service features requiring authentication.
- Adult Account means a User Account whose holder has attested to being of legal age and, where applicable, provided the supporting documents required by the Platform.
- Organization means a group of Users who can share Content, Creative Credits, and Custom Design Requests within a shared digital collaborative space on the Platform.
- Artist means a User who shares content on the Service, notably as a Show Arrangement, a Figure, or an Effect, or who responds to custom design requests. The Artist uses the Service for artistic creation, visual composition, or development of creative content shared on the Platform.
- Producer means a User using the Service to design and produce artistic drone shows, in part or in full. They own the drones and the authorizations or can obtain the necessary permits to produce a Drone Show.
- Client means a User who engages Drawn Lights or its Users for a project, commission, or drone show service.
2.3. Technical terms
- API means the Drawn Lights application interface for programming and automations.
- Intellectual Property means all intellectual property rights attached to Content. Unless expressly stated otherwise, uploading Content does not transfer ownership to Drawn Lights or any other User. The Artist remains the holder of economic and moral rights. Delivery of files, including the Content source, is strictly for technical use and does not transfer rights.
- Consumables means items that consume technical resources via Creative Credits when used within the Service, including:
> - Computations: processing, analysis, or transformation operations executed by the Service at a User's request. Excludes Video Render, 3D Render, Generation, and Smart Edits as primary categories.
- Creative Credits means units of value, purchasable or granted, used to access certain features or Consumables.
> - Video Renders: a processing operation producing a video file representative of Content.
> - 3D Renders: an interactive rendering session to display, manipulate, or explore Content in a three-dimensional environment.
> - Generation: partial or full creation of Content by the Service from user-provided instructions or parameters.
> - Smart Edits: automatic transformations using algorithms or AI.
2.4. Content and promotions
- Content means any creative, visual, audio, textual, or digital element uploaded, generated, or shared by a User on the Service, including Figures, Effects, Transitions, and Show Arrangements.
- Figures means the unit elements of a Show Arrangement, abstract or figurative, published by an Artist or obtained via Generation.
- Effects means visual and/or audio and/or movement transformers that can be applied to another type of Content, notably a Figure, a Transition, or a Show Arrangement.
- Transitions means visual or temporal linking effects between two Figures within a Show Arrangement.
- Show Arrangements means the design of a light drone show, a combination of Figures, Transitions, Effects, and other elements, intended to be rendered as video, interactive 3D, and ultimately in a Drone Show by a Producer.
- Explicit Content means any Content of a mature nature, notably artistic, violent, or sexual, likely unsuitable for minors. Explicit Content may only be created, viewed, or integrated by holders of an Adult Account. Publication is allowed solely for artistic or experimental purposes, subject to applicable law and the Platform's moderation rules.
2.5. Specific services and extensions
- Complementary Services means additional features made available to Users, including:
> - White Label: provision of the Service under a third party's visual identity pursuant to contract.
> - External Render Links: integration or sharing of renders hosted on the Service outside the Service.
> - Private Storage: private or restricted sharing within a non-public area of the Service.
2.6. Support formats
- Dedicated Support (priority) means technical or functional assistance provided on request.
- Community Support means resources provided by Drawn Lights such as videos, documentation, blog posts, AI, examples, and Discord.
- Personalized Onboarding means an assistance service for using the Platform.
- Custom Design Requests means requests for specific Content with Exploitation Right automatically granted, exclusive or not.
3. Access to the Service
The Service is accessible to any Visitor or User with an Internet connection. Access costs are borne by the Visitor or User.
Drawn Lights strives to provide continuous access without guaranteeing permanent availability or error-free operation. Access may be suspended for maintenance or updates.
4. Acceptance of the Terms of Service
By accessing and using the Application, the Visitor or User acknowledges having read and understood these Terms of Service and agrees to be bound by them.
If the Visitor or User does not agree with all or part of the Terms of Service, they must stop using the Application.
5. Creative Credits
Creative Credits are a payment facility for Consumables and certain features. Non-refundable except as required by law, not exchangeable for money, and hold no value outside the Platform.
They may be purchased in credit packs priced in euros including VAT. Prices and pack composition may change.
Credits remain valid indefinitely while the Account is active and compliant with these ToS. Non-transferable between Users but shareable within an Organization.
If an Account is deleted or suspended for ToS violations, the associated Credits are cancelled without compensation.
6. Content Usage Rights
When publishing Content, the Artist sets the rights granted to other Users and to the Service across three levels: Viewing, Integration, Exploitation. Each level has specific rules on visibility, use, and remuneration.
6.1 Viewing Rights
Define the conditions under which Content can be viewed on the Platform.
On publication, the Artist sets the visibility.
Public: visible to all Users.
Restricted: visible only to designated Users or groups.
Private: accessible only to the Artist.
No financial consideration. Viewing only. No authorization to modify, reproduce, or integrate.
6.2 Integration Rights
Govern the incorporation of Content into other digital content or a Show Arrangement on the Platform for design, simulation, or rendering purposes.
On publication, the Artist defines integration conditions.
Types or categories of Content with which integration is allowed.
Integration restrictions, such as excluded categories, projects, or uses.
No direct remuneration. No commercial exploitation rights are conveyed.
6.3 Exploitation Rights
Define use in a public or commercial context, notably within a Drone Show or any distribution outside the Platform.
On publication, the Artist specifies:
Acquisition constitutes a transfer of rights, not a temporary license. The purchasing Producer or Client uses the Content per the Artist's parameters and these ToS.
For a Custom Design Request, Exploitation Rights are automatically transferred to the Client and benefit the Producer executing the Show.
Exclusivity may be negotiated in a Custom Design Request or set at publication.
6 bis. Allowed content and restrictions by Account type
Drawn Lights supports creative freedom while complying with the law and protecting the public. Access and publication conditions vary by Account type.
Standard Accounts
Only all-ages Content. Content that is violent, sexual, discriminatory, or likely to offend is prohibited.
Adult Accounts
Creation, viewing, and integration of Explicit Content of a mature nature under the following conditions:
Artistic, narrative, or experimental intent.
No pornographic purpose and no explicit incitement to sexual activity.
No degrading, discriminatory, or illegal representation.
Content must be flagged as explicit for filtering and restriction to Adult Accounts.
Strictly prohibited content
Pornographic content or content aiming to cause sexual arousal.
Any depiction or suggestion of minors in a sexual context.
Extreme or realistic violence likely to shock or traumatize.
Content violating human dignity, inciting hatred, discrimination, or illegal activities.
Drawn Lights may moderate, restrict, or remove any non-compliant Content without notice or compensation.
7. User Account
When creating a User Account, the User agrees to provide accurate information and keep it updated. They are responsible for keeping their credentials confidential and for all activity under their Account.
Drawn Lights may suspend or delete an account in case of ToS violations.
8. Use of the Service
The User agrees to:
Not disrupt the proper functioning of the Service.
Not attempt to access unauthorized areas.
Not mass-extract or reuse data and content without prior approval.
Not use the Service for illegal purposes or contrary to public decency.
8 bis. Intellectual property and licenses
Content remains the property of its authors. Drawn Lights holds no ownership rights but benefits from a non-exclusive, worldwide, royalty-free license for the Service's technical needs, including hosting, display, indexing, security, and institutional promotion.
The license ends when the author deletes the Content, subject to legal retention obligations and necessary technical traces.
8 ter. User conduct and moderation
The User complies with the law and these ToS. Drawn Lights may moderate, restrict, suspend, or delete any non-compliant Content or Account without notice or compensation.
Reports: contact@drawnlights.show. Drawn Lights may retain elements necessary to handle reports and meet legal obligations.
9. Drawn Lights liability
Drawn Lights strives for reliability, availability, and security. Use of the Service is at the Users' sole risk. Drawn Lights is not liable for:
Technical, IT, or compatibility issues with Users' hardware, software, or networks.
The intrinsic characteristics of the Internet, including reliability and security.
Interruptions, errors, or data loss related to use of the Service.
Direct or indirect damages resulting from misuse of the Service or a User's fault.
Operational accidents occurring when using Content or a Show.
Third-party site content accessible via links.
Acts, errors, or omissions by third parties, including Producers, Clients, or Artists.
Drawn Lights' liability is incurred only in case of proven fault directly attributable to it and only for direct damages.
The Service does not meet any specific requirements beyond these ToS. The User is responsible for the security, backup, and use of their Content.
9 bis. Prohibited Conduct and Unauthorized Use
Drawn Lights is committed to protecting its intellectual property and the integrity of its Service. By using the Platform, the User agrees not to engage in the following prohibited activities:
9 bis.1. Circumvention of Purchase Mechanisms
The User must not attempt to bypass, disable, or tamper with any content protection mechanism, digital rights management (DRM) system, or purchase system for Creative Credits or Exploitation Rights implemented on the Service to protect Content and paid features.
9 bis.2. Automated Data Extraction and Collection
The User agrees not to use automated systems, software, or techniques such as robots, scrapers, spiders, or offline readers to access, acquire, copy, or monitor any part of the Service or its Content without prior written authorization from Drawn Lights. This includes any unauthorized data extraction, collection, or harvesting.
9 bis.3. Unauthorized Copying and Distribution
The User must not copy, reproduce, distribute, publicly display, or create derivative works from any Content on the Service without obtaining the corresponding Exploitation Rights or express written consent from Drawn Lights. Unauthorized copying or distribution of Content or any other intellectual property of the Service is strictly prohibited.
9 bis.4. Disruption of Service Operation
The User agrees not to interfere with, disrupt, or attempt to gain unauthorized access to any part of the Service, its servers, or related services. This includes any attempt to bypass security or authentication measures, access data not intended for the User, or introduce malware, viruses, or any other disruptive elements.
9 bis.5. Misuse of Intellectual Property
All Content available on the Service, including but not limited to Show Arrangements, Figures, Effects, graphics, logos, and text, is protected by the intellectual property rights of Drawn Lights or its Artists. Any unauthorized use, reproduction, or distribution of such Content without valid Exploitation Rights is prohibited and may result in legal action.
9 bis.6. Abuse of the Creative Credits System
The User agrees not to engage in activities that abuse the Creative Credits system or attempt to circumvent purchase and licensing processes. This includes, but is not limited to:
Attempting to create or use fraudulent Creative Credits.
Sharing or transferring Creative Credits between Accounts outside the authorized Organization framework.
Using automated systems to purchase or use Creative Credits.
Exploiting bugs, loopholes, or malfunctions in the Creative Credits system.
10. Personal data
Processing of personal data is governed by the Privacy Policy compliant with the GDPR, available at /confidentialite. Rights of access, rectification, and deletion: contact@drawnlights.show.
11. Cookies
The Service may use technical and analytics cookies. See the Cookies Policy at /cookies for management options.
11 bis. Forbearance and severability
Failure by Drawn Lights to enforce any provision does not constitute a waiver.
If any clause is void, the remaining provisions remain in force.
12. Changes
Drawn Lights may modify these ToS at any time. The applicable version is the one published at the date of consultation.
13. Governing law and jurisdiction
These ToS are governed by French law. Exclusive jurisdiction lies with the courts of Paris, unless otherwise provided by law.
